ORDINANCE NO. 18 1999

AN ORDINANCE PROHIBITING THE SOLICITATION AND/OR
DISTRIBUTING OF INFORMATION AND/OR MATERIAL
BY PEDESTRIANS ON THE PUBLIC STREETS, ALLEYS
AND/OR ROADWAYS WITHIN THE CITY OF COLUMBUS

WHEREAS, public safety is important to the citizens of the City of Columbus, Indiana and the citizens of Bartholomew County, Indiana; and

WHEREAS, it is in the best interest of the City of Columbus, Indiana, and motorists who use the public streets, alleys and/or roadways that said public streets, alleys and/or roadways be free of pedestrians soliciting and/or distributing information and/or materials to motorists using said public streets, alleys and/or roadways; and

WHEREAS, it is in the City's best interest and the motoring public who would utilize said public streets, alleys and/or roadways, that said pedestrian solicitors and/or distributors be prohibited from utilizing said public streets, alleys and/or roadways for the purpose of soliciting and/or distributing information and/or materials to motorists using said public streets, alleys and/or roadways; and

WHEREAS, it is determined that the need to maintain the public streets, alleys and/or roadways absolutely free and clear of solicitation and/or distribution of information and/or materials of any type or nature to motorists using said public streets, alleys and/or roadways is paramount to the public safety of the City of Columbus.

NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of Columbus, Indiana, as follows:

SECTION I - SOLICITATION AND/OR DISTRIBUTION

The City prohibits pedestrian solicitation and/or distribution of information and/or materials of any type or nature to motorists using any public streets, alleys and/or roadways located within the corporate limits of the City of, Columbus. This solicitation and/or distribution prohibits pedestrians fiom soliciting and/or distributing materials or information of any type or nature while standing or otherwise being within the public streets, alleys and/or roadways and in the public rights-of-way contiguous to said public streets, alleys and/or roadways, excluding city sidewalks.

This Ordinance shall not apply to licensed retail businesses that operate motor vehicles to facilitate their business on or around said public streets, alleys and/or roadways.

Pedestrians found in violation of this chapter shall be subject to a fine of One Hundred Dollars ($100.00) upon the first offense. Any pedestrian committing a second or subsequent violation within any one-year period shall be subject to a fine of Five Hundred Dollars ($500.00). Each act of or attempted act of solicitation and/or distribution of materials or infonn.~tion shall be considered a separate offense.

SECTION II - EFFECTIVE DATE

This ordinance shall be effective on the date of its passage.
